In this paper on the scope of application of the EU Regulation on matrimonial property the following questions will be discussed: 1. What is a “marriage” in the context of the Regulation? 2. Where is the division between matrimonial property law and succession law according to the Mahnkopf case? 3. How is the régime primaire covered by the Matrimonial Property Regulation? Via application of the lex causae and/or via art. 30 of the Regulation? 4. Are the other excluded subjects the same as in the Succession Regulation? |
