Exploitatie van torrent-site The Pirate Bay die ongeautoriseerde file sharing faciliteert geldt niet als openbaarmaking in auteursrechtelijke zin, maar is wel onrechtmatig omdat The Pirate Bay gelegenheid geeft tot het structureel verwijzen naar auteursrechtelijk beschermd materiaal en daardoor auteursrechtinbreuk bevordert. Oprichters van The Pirate Bay zijn wegens hun betrokkenheid persoonlijk aansprakelijk.
