| Abstract |
Having ascertained its jurisdiction and the applicability of Italian law, the Modena District Court orders Booking.com to compensate the pecuniary and non-pecuniary damages suffered by the plaintiffs for booking a “ghost structure”. The comment highlights the problems of attributing to the online platform “the obligations relating to the mediation contract”, without discussing the safe harbour established by Dir. 31/2000, as a way of translating the damage “at all costs”.
