Abstract
This chapter outlines the key dimensions of international trade and investment law from a sustainability perspective. The central question is how this area of law can contribute to the necessary transition to a climate-neutral, sustainable society, which elements within this area of law may hinder this transition, and how reforms can be achieved. This approach not only provides a global perspective but also explicitly addresses the European and Dutch contexts. Recent developments surrounding the Energy Charter Treaty (ECT) and the European Union's (EU) withdrawal from it in 2024 provide a key example of the tension between trade and investment rules on the one hand and international climate and environmental policy on the other.
